Terms of Service

This terms of service is an agreement between you, the customer, (including you, and any agents or representatives authorized by you), which may heretofore be referred to as “you”, “your”, “customer” or “user”, and Tierl LLC, which may heretofore be referred to as “we”, “us”, “our” or “Tierl”. This agreement covers the services offered by Tierl and used by or purchased by you. The services generally fall in the category of website server hosting, virtual private servers (VPS), dedicated servers, VPN services, proxy services, network connectivity, or other applicable terms.

1. Changes to the TOS These terms of service may be changed by Tierl from time to time, with or without notice.

2. Billing terms

Refund Policy (Strictly No Refunds) All payments to Tierl are final and non-refundable. By signing up for our services, you agree that there will be NO REFUNDS provided for any reason. This includes, but is not limited to:

  • Service Unavailability due to Government Blocking: We do not offer refunds if your service (IP address or port) becomes blocked, blacklisted, or throttled by any government firewall (e.g., GFW), censorship authority, or ISP after the service has been provisioned.

  • Performance Issues: No refunds for network latency or speed issues caused by external network congestion or routing beyond our control.

  • Suspension: Services that are suspended or terminated due to non-compliance of the AUP and TOS are not eligible for refunds.

  • Cryptocurrency: Payments made via Bitcoin or other cryptocurrencies are strictly non-refundable.

  • Change of Mind: We do not offer refunds for "change of mind" or if you simply decide you no longer need the service.

Billing Methodology and Information Tierl invoices for all services 14 days prior to the due date. You are responsible for arranging payment by the due date. Accounts that become past due will be subject to a 10% (ten percent) late fee after 2 days of being overdue. Tierl may, at its sole discretion, add additional late penalty fees to repeat offenders. After an invoice becomes 1 day past due, all services affiliated with the invoice are subject to immediate suspension and will be terminated after 3 days past due.

Fraud In the event fraud is discovered, the fraudulent customer is subject to immediate suspension/termination at the sole discretion of Tierl. All information available to Tierl about the fraudulent account/server will be submitted to both local authorities, as well any financial institutions involved.

Disputes and Chargebacks The Customer acknowledges that any attempt to dispute or initiate a chargeback with Paypal, Credit Card issuer, or any payment gateway will result in a permanent ban, immediate termination of all services, and reporting to industry fraud databases. A chargeback imposed under false pretenses is considered Fraudulent.

Cancellation notice Users may cancel their service at any time via the cancellation form provided in the client area. Cancellation does not generate a refund for any unused time. To cancel: Client Area > Services > My Services -> Click on the service -> Request Cancellation.

3. Prices

Price Changes: Tierl reserves the right to change prices for services at the start of a customers next billing cycle.

Currency: All services are priced in US dollars unless otherwise stated.

4. VPN and Proxy Specific Terms

VPN/Proxy Disclaimer: Tierl may provide services compatible with VPN or Proxy usage (e.g., Shadowsocks, V2Ray, OpenVPN, WireGuard).

  1. Connectivity: Tierl makes no warranty that the service will be accessible from all locations or networks. You acknowledge that access to the service may be restricted by firewalls, censorship, or network filtering in your country (e.g., China, Iran, Russia). We do not guarantee the ability to bypass these restrictions.

  2. IP Blocking Risk: You acknowledge the risk that IP addresses may be blocked by third parties (such as the GFW) at any time. Tierl is not responsible for replacing IPs blocked after the service is delivered. Replacement of blocked IPs, if offered, may incur an additional fee.

  3. User Responsibility: You are solely responsible for ensuring that your use of our VPN/Proxy services complies with the laws of your local jurisdiction. Tierl disclaims all liability for any illegal acts committed by you while using our services, including but not limited to accessing prohibited content or evading local regulations.

  4. No Logging Policy: For VPN services, we aim to minimize data retention to ensure privacy, but we will cooperate with valid legal requests from jurisdictionally competent law enforcement authorities if required.

5. Support As our services are unmanaged, Tierl provides hardware support only. We do not provide software support for setting up VPN clients, proxy configurations, or "wall-crossing" tools. You are expected to have the technical knowledge to configure your own services.

6. Backups and Data Loss Your use of the service is at your sole risk. Tierl is not responsible for files and/or data residing on your account.

7. Abuse Policies

Legal Use & Indemnification: Tierl services may only be used for legally permissible purposes. You agree to indemnify and hold harmless Tierl from any claims resulting from the use of our service that damages you or any other party. Violations include but are not limited to:

  • Distributing child pornography (Zero Tolerance).

  • Sending Spam/Bulk Email.

  • Phishing or hacking activities.

  • DDoS attacks (Outgoing).

Content Monitoring: We generally do not monitor the content of traffic (especially encrypted VPN traffic). However, we reserve the right to suspend services if we receive abuse complaints or detect abnormal traffic patterns indicating a DDoS attack or spamming.

Bit Torrent & P2P Policy: Strictly Prohibited. The use of BitTorrent, P2P (Peer-to-Peer) software, or any file-sharing applications to download or distribute copyrighted material is strictly prohibited on all Tierl services.

  • We have a zero-tolerance policy for DMCA complaints.

  • Any service found to be running public torrenting (PT/BT), or receiving a DMCA copyright infringement notice, will be suspended immediately without refund.

  • This policy applies to both the VPS itself and any VPN/Proxy traffic passing through the service.

Resource Usage (Fair Share):

  • Bandwidth: The network port is fair-shared. Constantly consuming high amounts of bandwidth (e.g., maxing out the port 24/7) is not allowed and may result in throttling.

  • CPU: CPU cores are shared. Abuse of CPU (e.g., crypto mining) will result in suspension.

8. Limitation of Liability IN NO EVENT SHALL Tierl, ITS EMPLOYEES, OR AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, OR USE, INCURRED BY YOU OR ANY THIRD PARTY, WHETHER IN AN ACTION IN CONTRACT OR TORT, ARISING FROM YOUR ACCESS TO, OR USE OF, THE SITE OR ANY SERVICES PROVIDED.
